ARTICLE 5 – ORDER TERMS
To validate his/her request, the User must contact AlpAddict by telephone or by email in order to arrange a first free and non-binding telephone meeting during which he/she can provide AlpAddict with the essential and necessary information relating to the search for the components of the trip and the creation of an itinerary in line with the customer's expectations.
At the end of this first meeting, or if necessary after some research, at the latest 48 hours after this telephone meeting, AlpAddict will be able to inform the User whether AlpAddict is able to respond to this request.
If this is the case, AlpAddict will offer one of the two support packages proposed in article 4 “Price”.
If the User agrees, AlpAddict will send the user by email the quote, the T&Cs and the payment link corresponding to the package (payment by credit card).
The quote must be returned dated and signed to AlpAddict by the User. Payment must be made for the AlpAddict support service to begin.
Once payment has been made, AlpAddict begins its service activity.
The User will then be informed by email of the start of the service.
AlpAddict then carries out a search enabling it to find and determine means of transport and accommodation corresponding to the User's budget and to create the itinerary according to the chosen formula.
The AlpAddict Travel Planner will take charge of designing the trip requested by the User within a maximum of 7 days and will offer it to them in the form of a Travel Diary.
AlpAddict will send the Travel Diary to the User by email and this step will mark the end of the AlpAddict service.
If the User is interested in the proposals made in the electronic travel diary communicated by AlpAddict, he must then make his final choice and book as soon as possible (within 24 hours maximum to benefit from the indicative rates indicated in the Travel Diary, without this being a firm rate to which AlpAddict commits) himself via the sites indicated by AlpAddict.
AlpAddict is not responsible if the prices and availability indicated in the response email are no longer available at the time the User wishes to make their reservations.
ARTICLE 6 – TERMS OF PAYMENT
Payment is made only by credit card through a secure payment link and implemented by a professional online payment service provider chosen by AlpAddict (SUMUP). This service provider ensures its smooth running and security. AlpAddict does not intervene in the context of financial transactions carried out on the site, which are carried out under the sole and exclusive responsibility of said service provider.
AlpAddict reserves the right to refuse access to the services, or to suspend it, in the event of a payment incident or in the event of fraud, attempted fraud or risk of fraud relating to the use of the site.
ARTICLE 7 - RIGHT OF WITHDRAWAL
AlpAddict draws the customer's attention to the provisions of article L. 221-28 of the Consumer Code:
"The consumer has a period of fourteen days to exercise his right of withdrawal from a contract concluded remotely, following telephone or off-premises canvassing, without having to justify his decision or bear costs other than those provided for in Articles L. 221-23 to L. 221-25."
The User accepts that the provision of services begins before the end of the withdrawal period, and this upon payment of the invoice.
To the extent that AlpAddict will begin the execution of the service within fourteen days following payment of the invoice (and therefore acceptance by the User of the contract and the General Terms and Conditions), the User expressly declares that he waives his right of withdrawal.
The purchase is considered final upon receipt by AlpAddict of the dated, signed quote and the corresponding payment made.
ARTICLE 8 – LIMITATIONS OF LIABILITY.
AlpAddict is not a travel agency and never makes reservations on behalf of the Client. AlpAddict is a service provider in the field of travel optimization and, as such, provides an exclusive consulting service in the organization of personalized trips.
Considering the nature of the services provided, the obligation incumbent on AlpAddict is an obligation of means, to the exclusion of any obligation of result, which the User expressly acknowledges.
In the event of difficulty before, during or after the trip, only the service providers (accommodation, transport, activities, etc.) chosen by the User may be held liable.
AlpAddict cannot be a party to any dispute between the User and any travel provider, since it acts as an advisor.
The prices of each service transmitted by AlpAddict to the User are those noted online on the date the proposal email was sent.
Providers are free to modify their prices without notification according to their own general conditions of sale.
AlpAddict cannot be held responsible for the consequences of the following events:
- Failure to present or presentation of expired or insufficiently valid identity and/or health documents (identity card, passport, visas, vaccination certificate, etc.) or non-compliant with the formalities at the customs or check-in police station. In the event of failure to register (including for delays in boarding), 100% of the total cost of the trip will be retained as a fee.
- Incidents or events of force majeure beyond AlpAddict's control such as: wars, political unrest, strikes beyond AlpAddict's control, technical incidents beyond AlpAddict's control, congestion of railway space, bad weather, delays (including delays in mail delivery services for the transmission of travel documents), breakdowns, loss or theft of baggage or other effects. The delay(s) suffered originating from the cases referred to above as well as any itinerary changes that may result from them will not give rise to any compensation for any reason whatsoever, in particular due to the modification of the duration of the initially planned program or a delay in a connection. Any additional costs related to a disruption (tax, hotel, parking, etc.) will remain the responsibility of the customer.
- Cancellation imposed by circumstances of a force majeure nature and/or for reasons related to customer safety and/or upon injunction of an administrative authority.
- Actions of tourism providers and/or their employees and/or any third party required to provide services to the User.
- Difficulty or failure to book with the service providers offered in the travel diary (accommodation, activities, visits, excursions, etc.), since this is an advisory service.
- Price fluctuations applied by service providers, which the User expressly acknowledges.
AlpAddict provides a tailor-made consulting service for organizing travel and searching for services in order to save the User time. Responsibility for all bookings and the smooth running of the stay therefore lies with the User.
Thus AlpAddict cannot be held responsible for the poor progress of the stay, a bad travel or service experience, a cancellation or modification on the part of a service provider or an unforeseen event of any nature (health crisis, confinement, curfew, natural disasters, exceptional climatic conditions, internal or national strikes, riots, political crises, etc.).
The booking and choice of the trip will be the sole responsibility of the User. The service offered by AlpAddict is only a consulting service in terms of bookings and travel planning. AlpAddict does not guarantee to the User that the organization and planning of the trip, subject to constant research to improve in particular its performance and progress, will be totally free of errors, defects or faults.
In any event, AlpAddict's liability will be expressly limited to the Price paid by the User, any dispute and any damage combined and for the entire duration of the provision of the services.
